Terms & Conditions

McFlys - Terms and Conditions
Effective Date: May 2026

These Terms and Conditions govern all bookings with McFlys (the “Company”), a UK-based business offering static display hire of the Delorean DMC-12 and Lotus Esprit Turbo. By making a booking you agree to these Terms and Conditions.

1. Our Service

  • We provide the Delorean DMC-12 and/or Lotus Esprit Turbo for static display only.

  • The cars are not available for driving under any circumstances.

  • Bookings are for local events only and subject to availability.

  • Payment must be made in full at the time of online booking.

2. Booking Confirmation

  • A booking is only confirmed once you receive a confirmation email from us after following the supplied payment link.

  • We reserve the right to refuse or cancel any booking at our sole discretion.

3. Cancellations & Refunds

  • You may cancel your booking up to 30 days before the event date for a full refund (minus any transaction fees).

  • Cancellations made less than 30 days before the event are non-refundable unless we are unable to provide the vehicle. This is due to the long 'booking ahead' time associated with this type of service.

  • We may cancel a booking due to unforeseen circumstances (see section 5 below). In such cases, we will offer you an alternative date/vehicle where possible or a full refund.

4. Vehicle Availability & Breakdowns

We will use our best endeavours to supply the booked vehicle on the agreed date and time. However, these are classic cars and mechanical issues can occur despite regular maintenance.

  • If the booked vehicle is unavailable due to a breakdown or mechanical failure, we will:

    1. Offer a suitable alternative vehicle where possible, or

    2. Provide a full refund.

  • We will notify you as soon as reasonably practicable if a vehicle becomes unavailable.

  • We are not liable for any additional costs you may incur (e.g. venue hire, advertising, lost profits) due to a vehicle not being supplied.

5. Force Majeure

We shall not be liable for any failure or delay in performing our obligations if the failure is caused by events beyond our reasonable control. This includes (but is not limited to):

  • War, civil unrest, terrorism, or threat of terrorism

  • Pandemic, epidemic, or government restrictions

  • Extreme weather conditions

  • Fire, flood, or other natural disasters

  • Road closures or traffic issues preventing delivery

  • Any other event considered “force majeure” under UK law

In such cases, we will attempt to contact you as soon as possible and offer either an alternative date or a full refund.

6. Damage to the Vehicles

You (the customer) are responsible for the care of the vehicle while it is in your care or at your event.

You agree to pay for any repair or restoration costs if damage occurs due to:

  • Misbehaviour, negligence, or reckless actions by you, your guests, staff, or contractors

  • Interference with the vehicle (e.g. sitting in it without permission, touching moving parts, climbing on it)

  • Damage caused by the display environment (e.g. poor ground conditions, barriers failing, other vehicles, or equipment at the venue)

  • Any act or omission that voids our insurance

You must not allow anyone to drive, tow, push, or move the vehicle.

7. Insurance & Liability

  • The vehicles are fully insured for static display use. However, you remain liable for any damage that falls outside of our insurance policy (particularly customer-caused damage).

  • Our total liability to you under any booking shall not exceed the amount you paid for that booking.

  • We are not liable for any indirect or consequential losses (e.g. loss of profit, reputation, or third-party claims).

8. Health & Safety

  • You are responsible for the safety of your guests around the vehicles.

  • You must ensure any appropriate barriers and signage (supplied by McFlys) are in place to prevent guests from touching or climbing on the cars (unless we have specifically agreed otherwise in writing).

  • Children must be supervised at all times near the vehicles.

9. Photography & Marketing

We reserve the right to take photographs and videos of the cars at your event for our own marketing and social media purposes, unless you specifically request otherwise in writing before the event.

10. Data Protection

We process your personal data in accordance with our Privacy Policy and current UK data protection legislation (UK GDPR).

11. General

  • These Terms and Conditions are governed by the laws of England and Wales.

  • If any part of these terms is found to be invalid, the remaining terms remain in effect.

  • We may update these Terms and Conditions from time to time. The version in place at the time of your booking will apply.

 

By booking with McFlys you confirm that you have read, understood, and agree to these Terms and Conditions.
